President Trump made clear in his first week of office by way of two Executive Orders that one of the priorities for his Administration was to eliminate unlawful discrimination in the context of DEI.  Now that the EEOC has a quorum, the EEOC has commenced investigations, subpoena enforcement actions, and prosecutions against a number of employers relative to potential or alleged “illegal DEI.”  In one case, the EEOC is seeking punitive damages in the absence of any economic harm based on the alleged illegal conduct.

The DOJ also is investigating federal contractors and grantees with regard to their DEI practices.  To the extent the DOJ finds discrimination, it may commence litigation under the False Claims Act; the False Claims Act affords the government broad powers that can result in lengthy and wide-ranging investigations and enormous potential liabilities, including treble damages and significant per-claim penalties.

In this webinar, we will explore:

  1. Current EEOC litigation and DOJ investigations and what they portend for future government actions;
  2. DEI practices that may invite challenge not only by federal agencies but also by private plaintiffs;
  3. Potential liability under Title VII and the False Claims Act; and
