Course Description

Earlier this year, the U.S. Department of Labor issued an opinion letter reminding employers that employees enjoy the benefits of all applicable leave laws, not just what an employer feels is “better suited” to cover the situation. A good reminder that leaves of absence compliance requires a balancing of myriad leave laws.

This program will provide an overview of the key, and sometimes competing, challenges employers face when complying with the Family and Medical Leave Act, Americans with Disabilities Act and similar state and local laws. The session will review employer obligations to provide intermittent and reduced leave, when the ADA interactive process applies, and the interplay of paid time off benefits, workers compensation benefits and short term disability benefits. We will also review the new obligations under the Pregnancy Workplace Fairness Act and the PUMP Act and the importance of ensuring compliance with any additional state and local law requirements.
