Spotlight On: Remote Work as a Reasonable Accommodation

Employers in 2024 are increasing their requirements for in-person work.  Not surprisingly, employee requests to permit remote work are on the rise, triggered by return to in-person operations.

And while the Fifth Circuit in Montague v. United States Postal Service acknowledged the “general consensus among courts” that regular, in-person work is an essential function of most positions, an employer must continue to respond to disabled employees’ remote work accommodation requests.

This webinar will review the employer’s interactive process, including how to determine if an employee has a qualifying disability, whether the remote work accommodation may reasonably be provided and how to evaluate alternative accommodations.

This program will focus on:

  • The impact of EEOC guidance on the availability of remote work as a reasonable accommodation, including for employees with long COVID
  • Factors considered in recent court decisions analyzing whether remote work is a reasonable accommodation
  • Recent EEOC lawsuits and settlements involving remote work as a reasonable accommodation
  • The implications of previously-offered remote work during the COVID-19 pandemic on employers’ argument that remote work is an undue hardship
