Over the last few years, in the wake of the “Me Too” movement, employers of all sizes and across industries increasingly – and for good reason – have focused on pay equity. But for a company getting started, or taking the next step, on its pay equity journey, the legal requirements and practical considerations implicated by efforts to achieve pay equity can be daunting.
Many states now have pay equity laws that expand or establish different standards than those under federal laws like the Equal Pay Act. In addition, numerous states and localities have also enacted other laws seeking to address the persistent pay gap, including salary history bans, pay data reporting requirements, and pay transparency laws requiring pay or pay range disclosures to applicants and employees. Not to be outdone, government agencies, including the Equal Employment Opportunity Commission and the Office of Federal Contract Compliance Programs, also have stepped up enforcement and oversight to ensure compliance with pay equity laws.
Cognizant of this higher risk environment, employers seeking to address their legal responsibilities and mitigate their pay equity risk and potential exposure increasingly are turning to privileged and confidential pay equity audits to examine their payrolls and pay practices for potential disparities based on gender, race/ethnicity, and other protected group membership.
This course will examine the evolving landscape of laws relating to pay equity, and provide practical guidance to employers looking to conduct a pay equity audit as the next step in their pay equity journey.
