Course Description

In recent years, employers increasingly have embraced artificial intelligence (AI) as a way to streamline and standardize employment processes and decision-making, particularly with the use of AI in the hiring process. This move to adopt AI has only been accelerated by the COVID-19 pandemic, which forced employers to restructure their hiring processes to accommodate a remote work environment. And, without a doubt, employers can benefit from using AI in the hiring process, from increased efficiency to the potential to mitigate the implicit bias inherent in human decision-making. But AI has a “dark side” as well: when used without the appropriate safeguards in place to minimize the risk of adverse impact on protected groups, AI can create significant legal risk for employers.

Recently, federal agencies as well as state and local governments have taken steps to address the potential hazards of AI in the workplace, from inter-agency initiatives at the federal level to new laws restricting employers’ use of AI at the state and local level. This program will shine a light on the rapidly changing legal landscape of AI in the workplace, educate attendees regarding the risks (and potential benefits) of using AI in their companies’ hiring processes, and provide practical tips for compliance to help employers navigate risk in this emerging area of human resources and employment law.
