How an employer investigates harassment and abusive conduct claims may determine whether a claim is filed as well as liability and/or damages if a claim is filed. While abusive conduct is not unlawful per se (in the U.S.), such claims easily can be morphed into viable harassment claims. Plus, what are the cultural implications if abusive conduct remains unchecked?

This 2-part program will include an overview of some of the more salient issues in investigations. Particular attention will be paid to thorny issues such as:

  1. What to do if an employee requests that his or her complaint not be investigated?
  2. How far can an employer go in requesting or requiring confidentiality?
  3. How does an employer corrective action without admitting liability?

Through interactive exercises, the program also will focus on other issues, such as:

  1. The fine line between an appropriate and inappropriate questions with categories of inappropriate questions to avoid based on content or timing
  2. How to respond “in the moment” to common reactions by the parties to the investigation, such as a witnesses refusal to cooperate
  3. Making and documenting credibility determinations (the key to avoiding the all-too-often inconclusive determination)

This program will focus only on non-privileged investigations. A separate program on privileged investigations will be offered later in the year.

While the focus of the program is harassment and abusive conduct, much of the material discussed will apply to the investigation of other types of misconduct.
