Course Description

In 2021 the Pennsylvania Supreme Court in Heimbach v. Amazon.com, Inc. refused to interpret the definition of hours worked under the Pennsylvania Minimum Wage Act (PMWA) in the same way as the Fair Labor Standards Act (FLSA), stating that “the PMWA must be interpreted in accordance with its own specific terms.” And according to the Court, “the stark contract in the governing provisions of the two laws” required the Court to conclude that security screening time is compensable under the PMWA even though it is not under the FLSA. The Heimbach decision serves as an important reminder that at times Pennsylvania state law offers workers greater wage-related protections than the FLSA.

This webinar will assist Pennsylvania employers in avoiding common pitfalls under Pennsylvania wage and hour law.
