OSHA has modified its regulations for workplace inspections to permit OSHA compliance officers to allow third-parties, such as union representatives, worker advocacy organizations and attorneys, to join them on walkaround workplace inspections. This means that a compliance officer inspecting a non-union workplace may now be accompanied by a union official who does not work for the employer being inspected. Accordingly, it is more important than ever for employers to understand how to exercise their rights during OSHA inspections.
In addition, to encourage reports of workplace safety issues, OSHA now has the authority to grant visa certifications during inspections in support of applications for U Nonimmigrant Status and T Nonimmigrant Status visas. OSHA is also now teaming with the NLRB to address instances of retaliation under both the OSH Act and the National Labor Relations Act. In light of these developments, employers should exercise the rights they have to participate in and manage the inspection process.
