On January 10, 2024, the DOL published its final rule on independent contractor classification, revamping the standard it will apply to determine whether a company has classified a worker properly as an independent contractor or whether the worker is an employee entitled to minimum wage and overtime under the Fair Labor Standards Act (FLSA). The final rule officially rescinds the DOL’s 2021 test, which focused on two “core factors” (worker’s control over work and opportunity for profit or loss) and offered companies greater flexibility to classify workers as independent contractors. Scrapping the “core factor” concept in favor of a “totality of the circumstances” approach, the new final rule restores the six factors previously used by courts to assess the economic reality of worker relationships and allows for broad consideration of other relevant factors.
