Course Description

In the last several years, the U.S. Antitrust Agencies—the Department of Justice and Federal Trade Commission—have been intensifying their focus on the competitiveness of how firms hire, retain, and compensate their employees. In particular, the Agencies have been active in pursuing criminal and civil enforcement actions against companies and individuals that enter into “no-poach” agreements – that is, agreements not to hire each other’s employees. Recently, however, DOJ voluntarily dismissed its first criminal no-poach indictment. The program will focus on how antitrust enforcers and courts currently view no-poach agreements under the federal antitrust laws, as well as on the lesser but existing risk of non-solicitation agreements between two companies. HR professionals are key players in ensuring compliance with the antitrust laws as it relates to labor markets. This course will cover the applicable antitrust laws, best practices for compliance, conduct to avoid when it comes to poaching, price fixing and more, the consequences for violating the antitrust laws, and the benefits of having a robust antitrust compliance policy and training program at your organization.
