Managing employee FMLA leave requests can be challenging for any employer. Secure a meaningful and accurate FMLA certification, and an employer generally feels comfortable approving the leave request. However, when employees submit incomplete or inconsistent FMLA certifications, employers are faced with several difficult choices – challenge the certification and risk asking for too much, approve leave based on insufficient information or deny leave without giving an employee an opportunity to cure any deficiencies. Even after an initial FMLA certification is approved, employers may later question whether the employee’s pattern of absenteeism is supported by the certification.

What should an employer be prepared to do? There are a number of steps employers may take to get a meaningful and accurate FMLA certification. Employers should use those steps to challenge or clarify medical certification and be ready to obtain follow-up recertifications when appropriate. This webinar will focus on the scope of an employer’s right to secure meaningful and accurate FMLA certifications and recertifications, reasonable approaches to challenging certifications and methods to minimize the risks associated with denying leave where certifications are lacking. This webinar will also review recent COVID-19 guidance from the Department of Labor on the extent to which employees may utilize telemedicine appointments to support certifications of serious health conditions, and what COVID-19 related situations may be covered by traditional FMLA leave.
