Course Description:
This interactive webinar concentrates on some of the more difficult issues that HR professionals and in-house counsel face when conducting non-privileged investigations of harassment, discrimination and retaliation claims. Issues to be covered include:

• Special issues for remote investigations
• Key issues to raise in all, or virtually all, interviews (for example, how to address confidentiality, which will vary based on who is being interviewed)
• Interview questions: common mistakes and reframing them
• Recommended responses to common concerns/questions raised by complainants (keep confidential), witnesses (don’t want to get involved) and those accused (I want to sue)
• How to make findings of fact without unnecessary admissions
• How to make and document necessary and appropriate credibility findings
• When is the investigation “sufficient” in light of the employer’s legal responsibility
• Corrective action (including steps to minimize retaliation)
• Documentation of the process, decision-making, corrective action, etc.

A separate program on privileged investigations will be held on March 25th, 2021.
