Even though employers are no longer obligated to provide paid leave under the Families First Coronavirus Response Act (FFCRA), employers continue to face employee leave requests for COVID-19-related reasons. State and local laws are continuing to fill a perceived gap in the FFCRA coverage. This program will review the implications for covered employers who choose to offer FFCRA through March 31, 2021 and avail themselves of the available tax credits permitted under the recently enacted federal pandemic relief package. Looking ahead, we will consider the impact of expanded leave benefits under a Biden Administration proposed stimulus package, employer obligations under state and local law, potential employee leave rights under the FMLA and ADA and to what extent employer paid time off policies may be used to set off against any of these obligations.
