Course Description:
This interactive seminar will focus on four areas where some in-house counsel have been blindsided with recommendations on how to avoid the risks identified:
  • In-House Counsel as Chief Risk Manager with a focus on identifying and managing potential litigation risks in the age of social media and "fake news."

  • Ethics and Disciplinary Issues with guidance on the legal ethics and potential disciplinary issues faced by in-house counsel, with a particular focus on key potential pit-falls facing in-house counsel.

  • Educating Your Constituents with guidance to provide executives and other constituents on the nature of attorney-client relationship in general, with a particular focus on how executives and other constituents can maximize the privilege where appropriate and minimize the risk of inadvertent waiver.

  • Dealing with Government with guidance for making clear "who the client is," "common interest" privilege with employees, cooperation with government investigations and attorney-client privilege considerations.
