Course Description:
It is a delicate balance: An employer is entitled to establish expectations for employee performance and to require an employee to meet those expectations. On the other hand, at times, an employee’s disability, pregnancy or related medical condition may impact an employee’s performance and an employer is required to provide a reasonable accommodation to enable the employee to meet the essential functions of the position. Similarly, an employee’s need for accommodation may also take the form of a leave of absence or time off from work, another challenge to an employee’s ability to meet the requirements of an employee’s position. Knowing how to manage these issues and minimize legal risk requires effective performance management and an appreciation of an employer’s legal responsibility to engage in the interactive process. This seminar is designed for human resource professionals, in-house counsel and managers and will provide practical suggestions on how to maintain your organization’s quality and quantity standards while considering what reasonable accommodations may exist to enable employees to meet those standards.
