Course Description:
In this session, we will review various challenges employers face in connection with employees’ lawful medical or recreational marijuana use. We will analyze the impact state legalization of marijuana use has on employers’ ability to maintain a drug-free workplace, including:
  • The impact on employers' ability to reject applicants and discipline employees based on a positive drug test
  • The tension between federal law prohibiting marijuana use and state laws legalizing such use
  • Employee challenges to employer-adverse actions based on lawful, off-duty use theory and claims under the Americans with Disabilities Act (ADA)
  • Best practices for disciplining employees for workplace policy infractions in light of state law protections
  • Various state-law approaches to enabling employers to maintain a drug-free workplace and policy language considerations
